Evidence
- NRIs/OCIs cannot purchase agricultural land, plantation property, or farmhouses; residential and commercial open; inheritance route exists — Embassy of India, Qatar — official OCI property guidance, fetched live, 17 Jul 2026.
- Rule 24 of the FEM (Non-debt Instruments) Rules, 2019: an NRI/OCI may purchase immovable property other than agricultural land, plantation property or a farm house (24(a)); receive such other property as a gift from a relative (24(b)); inherit any immovable property (24(c)); sell agricultural land to a person resident in India (24(d)) — RBI FAQ on the NDI Rules (updated 6 Apr 2023) + RBI Master Direction on acquisition of immovable property (updated 1 Sep 2022), read 30 Sep 2026, 30 Sep 2026.
- India joined the Hague Apostille Convention in 2005, and a power of attorney is among the documents covered; an instrument executed out of India may be stamped within three months after it is first received in India (Indian Stamp Act, 1899, s.18) — MEA apostille page (last updated 17 Sep 2026) + Indian Stamp Act s.18, read 30 Sep 2026, 30 Sep 2026.
Palwal
NRI property work in Palwal
For an inherited holding in Palwal or Nuh district, the work starts with the record: the inheritance mutation (virasat) entered in the heirs' names, the shares settled, and the jamabandi read before any buyer is approached.
The purchase restriction applies here as anywhere in India: an NRI or OCI cardholder may not buy agricultural land, plantation property or a farmhouse. A Palwal purchase from abroad is therefore a plot or built property in a lawful residential or commercial category.
Selling a lawful existing holding is open: agricultural land you inherited, or acquired while resident in India, may be sold to a person resident in India (NDI Rules, r. 24(d)).
Much of the coordination can run from abroad — the record work, shortlists and video walkthroughs; who must attend the registration at the Palwal desk, and which originals are needed, is settled first. A power of attorney signed abroad on the proper route lets your attorney sign for you.
TDS on a sale and the repatriation of proceeds are flagged early and go to your chartered accountant; we coordinate, we do not give tax advice.
FEMA
What an NRI or OCI may do with land in India — FEMA, Rule 24
| The act | NRI / OCI | Rule |
|---|---|---|
| Buy agricultural land, plantation property or a farmhouse | Not permitted | NDI Rules 2019, r. 24(a) |
| Buy any other immovable property — residential, commercial | Permitted | r. 24(a) |
| Receive property as a gift from a relative | Permitted, except agricultural land, plantation property or a farmhouse | r. 24(b) |
| Inherit immovable property | Permitted — any immovable property | r. 24(c) |
| Sell agricultural land | Permitted, to a person resident in India | r. 24(d) |
From abroad to the registry — the power-of-attorney sequence
- The power of attorney is drafted for the specific act and the specific parcel — khewat and khasra named.
- It is signed abroad before an Indian consular officer, or notarised and apostilled where the country is a Hague Convention member — India joined in 2005, and powers of attorney are among the documents covered (MEA).
- Once it arrives in India it is stamped within three months of first receipt (Indian Stamp Act, 1899, s. 18).
- The attorney signs at the sub-registrar with the original in hand, on the signing day.
- After the deed, the mutation (intkal) is entered in the new owner's name.
The paper that lets someone act for you here: power of attorney, general.
The FEMA line, stated before anything is sold to you (verified against official guidance, 17 Jul 2026): purchase of agricultural land, plantation property, or farmhouses is not permitted for NRIs and OCI cardholders. Residential and commercial property needs no RBI permission. Agricultural land acquired while you were resident in India may continue to be held, and inheritance from a resident is the lawful route by which NRI families hold Palwal farm land today. Anyone selling you "NRI-safe farm land" against that rule is selling you a problem.
Within the rule, much of the work can run from abroad. Requirements arrive on WhatsApp across time zones. Same-day reply in working hours (Mon–Sat 10–7) — urgent: call. Finding land or checking records takes longer. (Times are IST.) Shortlists come with the honest picture per parcel. Site visits run on video — boundary pillars, approach road, the neighbours' fields, the papers held up to the camera. Document review happens against the digitised record on jamabandi.nic.in and the tehsil registers.
For registry acts, a properly executed power of attorney — signed abroad on the proper route and stamped here within three months of arrival — lets the deal complete without you flying in. Where families prefer to sign in person, we compress the ground work so one trip covers the visit and the deed. Inherited holdings get the unglamorous work first: mutations recorded, shares settled, records cleaned, then the market.
What a power of attorney can and cannot do: it acts only within the powers written into it, for the parcel named in it. A power of attorney does not itself transfer title — only a registered deed does (Supreme Court, Suraj Lamp & Industries v. State of Haryana, 2012) — and a GPA "sale" is not a conveyance. What needs attendance: whoever signs the deed — you or your attorney — appears at the sub-registrar on the signing day, with the original documents; the documents to have ready are your passport or OCI card, PAN, the stamped power of attorney and the title papers. Anything the record cannot settle goes to independent legal review before a token.
Tax questions — TDS on sale, repatriation of proceeds — are flagged early and routed to your chartered accountant; we coordinate, we do not improvise tax advice. The NRI guide cluster covers FEMA, OCI versus NRI rights, POA from abroad, gifts and inheritance, and sale-proceeds repatriation as those guides publish.

Send your requirement from anywhere
Buying, selling or verifying land in Palwal district and Nuh (Mewat) district — plots, farm land, commercial and industrial parcels — against a written requirement.
We do not take mandates whose only objective is to pressure an owner into a distress or knowingly under-value sale. For a valuation, send the village and khasra first.
Buying: the purpose, village or area, land type and size, budget, timeline, and whether the money is arranged. Selling: village, land type and size, whether you own it alone, jointly or by inheritance, whether all owners agree, asking price, timeline and the documents in hand. Verifying: district, tehsil and village, khasra or khewat, where the deal stands, and what worries you.
Same-day reply in working hours (Mon–Sat 10–7) — urgent: call. Finding land or checking records takes longer. After 19:00 and on Sundays, the reply comes the next working day. Your requirement is restated in writing and the record screened before any parcel is discussed.
Fee and scope are agreed in writing before any work begins. A site visit happens only after the requirement is in writing and a first record screen is done. Nothing is shared outside the practice without your say-so; where a partner is needed, they are named in the written terms first.
